PRIVACY POLICY IN THE ASSOCIATION 

DATA CONTROLLER
MÉDECINS SANS FRONTIÈRES ESPAÑA (hereinafter, "MSF ESPAÑA"), with registered address at C/ Nou de la Rambla 26, 08001 Barcelona, Spain.

WHAT ARE YOUR RIGHTS?
You can exercise your rights of access, rectification, erasure and portability, limitation and/or objection to processing by writing to C/ Nou de la Rambla 26, 08001 Barcelona, Spain or by sending an email to servicio.participacion@barcelona.msf.org.

Also, if you feel that the processing of your personal data represents a breach of the regulations or your privacy rights, you can file a complaint:
- To our Data Protection Officer, by writing to the postal or email addresses listed above.
- To the Spanish Data Protection Agency, either online or to its postal address.

HOW WE OBTAINED YOUR DATA
Your data were obtained when you requested to become part of the MSF ESPAÑA association, as a result of your relationship with the MSF ESPAÑA association or owing to the relationship you currently have with our entity, or because you have directly participated in one of our assemblies or participation and decision-making bodies.

WHAT PERSONAL DATA DO WE PROCESS?
The data that we process for the legitimate purposes laid out below consist of your identifying data (name, surnames, ID/Passport number, academic and professional details (training/studies, experience in MSF, CV/cover letter, your position as health/non-health personnel, your membership as national staff) and your contact information (address, e-mail, telephone).

In order for you to participate as an associate member, we also need to process certain data required for financial management (bank account or other forms of payment and endorsements).

Finally, the MSF ESPAÑA association will also process the data that may be generated based on your attendance and participation in the general assemblies of the MSF ESPAÑA association (such as your image and voice).

WHY DO WE PROCESS YOUR PERSONAL DATA?
MSF ESPAÑA processes your personal data because this is necessary to manage your membership (to process your membership application, for the financial management of your membership, for the management of assemblies and the associated website, and to send you information on initiatives that the MSF ESPAÑA association is carrying out for the purposes of its founding mission).

Likewise, the capture and recording of your image will serve to communicate and publish the holding of our general assembly across our communication channels, keeping MSF ESPAÑA employees and partners informed of the decisions taken in the operational mission, which are in line with our primary aim of providing medical and humanitarian services anywhere across the world.

WHY DO WE PROCESS YOUR PERSONAL DATA?
MSF ESPAÑA processes your personal data because this allows MSF ESPAÑA to meet its obligations deriving from your membership request to join the MSF ESPAÑA association, and also for the maintenance of your member status of the MSF ESPAÑA association.

The processing of your image captured in the general assemblies of the organisation, and the dissemination thereof within the associative environment of MSF ESPAÑA, is based on the legitimate interest of MSF ESPAÑA in keeping the members of the MSF ESPAÑA associative community informed of the holding of general assemblies via the channels routinely used by the MSF ESPAÑA association for this purpose.

WHEN AND WHY MAY WE PROVIDE YOUR DATA TO THIRD PARTIES?
Your data may be transferred to the recipients indicated below for the reasons described below:
• Public Administrations: for compliance with the legal obligations to which the MSF ESPAÑA association is subject due to its activity;
• Auditing companies: to comply with the legal obligations to audit accounts to which MSF ESPAÑA is subject due to its activity;
• Security forces and bodies: when our organisation is required to provide information in order to comply with a legal obligation;
• Transfers to third parties that are required in order to comply with the obligations derived from your member status (for example, banking entities);
• Providers that need access to your data for the provision of services that the MSF ESPAÑA association has contracted with these providers, and with which MSF ESPAÑA has signed the confidentiality and personal data processing contracts required and demanded by current regulations for the protection of your privacy;
• Also other MSF associations worldwide (https://asociacion.msf.es/en-GB/MSF-associations) in compliance with the provisions of our by-laws and in accordance with the obligations derived from your member status.

If the MSF ESPAÑA association make other personal data disclosures in the future, you will be duly informed of this.

INTERNATIONAL DATA TRANSFERS
MSF ESPAÑA has contracted the services of technological suppliers located in countries in which the regulations are not as strict as they are in Europe ("Third Party Countries"). These suppliers have signed the confidentiality and data processing contracts required by regulations for suppliers located in Third Party Countries with MSF ESPAÑA, applying the necessary guarantees and safeguards for the protection of your privacy.
MSF ESPAÑA also needs to make international transfers to other MSF associations worldwide (https://asociacion.msf.es/MSF-Asociaciones) in compliance with the provisions of our by-laws and in accordance with the obligations derived from your member status.

AUTOMATED INDIVIDUAL DECISIONS
The MSF ESPAÑA association does not make decisions that may significantly affect you based solely on the automated processing of your data. All of our organisation’s decision-making processes related to your application will be performed with human intervention.

HOW LONG WILL WE STORE YOUR DATA FOR?
Your personal data will be stored for as long as you are connected to MSF ESPAÑA, and once this relationship ends, for whatever reason, they will be stored for the applicable legal expiration periods. In this case, they will be processed for the sole purpose of proving compliance with our legal or contractual obligations. Once these expiration periods have elapsed, your data will be either deleted or made anonymous.

So if you consider that processing your personal data infringes the regulations or your privacy rights, you can lodge a complaint:
-  To our Data Protection Officer, through the postal and electronic addresses given.
-  At the Spanish Data Protection Agency, via its electronic centre or at its postal address.

 HOW WE OBTAINED YOUR DATA
If we have not had any relations before, we obtain your data through this form and will process this with any data which you supply to us during your relationship with us.

If we have already had relations the data which we have on you was obtained by means of the earlier relationship that you had with MSF ESPAÑA, or through the relations that you currently have with our organisation, either through your membership status, through having been a donor, having taken part in one of our campaigns, due to having requested us to send you information on our activities, campaigns and initiatives or through having taken part in one of our assemblies or participative and decision-making bodies.

WHAT PERSONAL DATA WE PROCESS
The data we have of you for the lawful purposes explained below is the data that you give us through the registration form which has to be filled out so that we can manage your participation in the MSF ESPAÑA assembly. Any data that may be generated while the assembly is being held will also be processed by MSF ESPAÑA.

If you have had earlier relations with MSF ESPAÑA, we will also process the data that you had given us as a result of the relations referred to.

We also wish to inform you that images will be taken and recorded during the assembly which you can register for by filling in this form. For this reason, in the event of your expressly authorizing MSF ESPAÑA to take and record your image, our organisation will also process this image.

WHAT WE PROCESS YOUR PERSONAL DATA FOR
MSF ESPAÑA processes the personal data that you supply us with in this form in order to manage your registration so that you can take part in our organization assembly.

In the event of your expressly authorizing MSF ESPAÑA to take and record your image, our organisation will also use your image for the purpose of disseminating and publishing the assembly held in our communication channels in order to keep all MSF ESPAÑA members, activists, employees and collaborators informed about the decisions made at the assembly, and so as continue with our foundational mission to give medical and humanitarian care services anywhere in the world.

Lastly, should you expressly authorize this, MSF ESPAÑA will process your personal data to send you information, even via electronic means, on the activities, initiatives and missions that MSF ESPAÑA carries out to undertake its founding mission.

WHEN AND ON WHAT GROUNDS WE MAY PROVIDE YOUR DATA TO THIRD PARTIES
Your data may be transferred to the recipients stated below, for the reasons described here:
-   Public Administrations: for compliance of the legal obligations by which MSF ESPAÑA is bound through its activity;
-   Providers who need to access your data to supply services that MSF ESPAÑA has contracted with those suppliers and with which MSF ESPAÑA has entered into confidentiality and personal data processing agreements necessary and required by regulations to protect your privacy.

If in the future MSF ESPAÑA should make other assignments of personal data, you will be properly informed of this.

INTERNATIONAL DATA TRANSFERS
MSF ESPAÑA has contracted services from technological providers located in countries which do not have regulations equivalent to European rules (“Third Countries”). These providers have signed contracts with MSF ESPAÑA covering the confidentiality and data processing required by regulations for providers located in Third Countries, applying the guarantees and safeguards needed to keep your privacy.

AUTOMATED INDIVIDUAL DECISIONS
MSF ESPAÑA does not make any decisions which may affect you in any significant way based only on automated processing of your data. All the decision-making processes of our organisation connected with your application will be made with human involvement.

HOW LONG WE WILL KEEP YOUR DATA FOR
Your personal data will be kept for as long as your relations with MSF ESPAÑA last, and after the end of those relations for any reason, for the legal limitation periods applicable. In this case, this will be processed for the sole purpose of compliance with our legal or contractual obligations. At the end of those limitation periods, your data will be deleted or alternatively, made anonymous.

SPECIFIC CONTENT ON ASSIGNMENT OF YOUR IMAGE
As has been referred to above, while the assembly is being held, MSF ESPAÑA will proceed to take and record images for the purpose of disseminating and publishing the assembly held in our communication channels in order to keep all the MSF ESPAÑA members, activists, employees and collaborators informed about the decisions made there, and so as to continue with our foundational mission to give medical and humanitarian care services anywhere in the world.

By signing this document, you have the chance to authorise MSF ESPAÑA to take and record your image during the assembly held and assign the rights of exploitation of your image to our organisation free of charge, with no time or geographical limit so that we can use this to attain our foundational aim without any use of this being made for any profit-making purposes by MSF ESPAÑA or others.
